The first 250 U.S. residents who (i) sign up for a Brightcove Express account via the Brightcove website at www.brightcove.com by November 30, 2010, (ii) remain a Brightcove Express customer in good standing through December 6, 2010, and (iii) complete the online rebate form available at http://gobrightcove.wufoo.com/forms/brightcove-express-html5-promotion-form/ by November 30, 2010 will receive one of the following gifts (based upon the applicable Brightcove Express edition purchased):

• $50 Apple^® store gift card when you subscribe to the Express $99 plan
• iPod touch^® (8 GB) when you subscribe to the Express $199 plan
• iPad^™ (16 GB with Wi-Fi) when you subscribe to the Express $499 plan

In order to be eligible, please follow these three simple steps:

• Subscribe to one of the three available Brightcove Express plans ($99/month, $199/month or $499/month) at www.brightcove.com using your credit card between November 11, 2010 and 11:59 PST November 30, 2010. Please note that Brightcove Express trial accounts are not eligible for this promotion – you may obtain a trial before becoming a paid subscriber, however, any trials must be converted to a paid Express account by November 30, 2010 in order to be eligible for this promotion.
• Complete the online rebate form located at: http://gobrightcove.wufoo.com/forms/brightcove-express-html5-promotion-form/ by 11:59 PST November 30, 2010.
• After you become a customer, maintain your Brightcove Express account in good standing through at least 11:59 PST December 6, 2010.

Additional Rules Governing This Promotion

1. This promotion is (i) valid only in connection with the subscription of a $99, $199 or $499 Express plan between November 11, 2010 and 11:59 p.m. PST November 30, 2010, (ii) not redeemable for cash, (iii) not valid on past purchases or subscriptions, and (iv) may not be combined with any other promotion. Current customers and customers upgrading, downgrading or cancelling existing Brightcove subscription plans are not eligible for this promotion.
2. Only US residents aged 18 years or older are eligible for this promotion.
3. The first 250 eligible primary account holders will receive one of the following gifts, depending on which plan was purchased:(i) $50 Apple^® Store gift card for Express $99 plan (valued at $50), (ii) iPod touch^® (8 GB) for Express $199 plan (valued at approximately $229), and (iii) iPad^™ (16 GB) for Express $499 plan (valued at approximately $499). The gift may not be redeemed for cash, and any portion of the gift not used will be forfeited. All taxes on the gift are the recipient’s responsibility. Brightcove may, at its discretion, substitute another gift of equal or greater value, and details of the gift may change based on availability. For the avoidance of doubt, Brightcove shall only distribute the number of gifts as there are people eligible for this promotion, up to a maximum of 250. Only one gift per person. Past winners of prior Brightcove promotions are not eligible for this promotion.
4. Brightcove makes no express or implied representations or warranties in connection with this promotion, including with respect to the gift. Any liability which may arise out of your acceptance or use of any component of the gift lies solely with the manufacturers of goods comprising the gift.
5. Brightcove shall not be liable for losses or damages of any kind arising from participation in this promotion, including any losses or damages that may arise from receipt of the gift awarded hereunder, and including any losses or damages that may arise from the shipping of the gifts through third party companies.
6. Brightcove shall not be responsible for entries that are incorrect, lost, late, damaged, misdirected, incomplete, or incompletely received, for any reason, including by reason of hardware, software, browser or network failure, or congestion of Brightcove’s servers.
7. Brightcove, in its sole discretion, reserves the right to disqualify any person suspected of tampering with the entry process, the operation of the Brightcove Service or otherwise violating these rules. Brightcove further reserves the right to cancel, suspend, terminate or modify any part of this promotion not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort beyond the reasonable control of the Brightcove, which corrupts or impairs the administration, security, or fairness of this promotion. Brightcove reserves the right, in its sole discretion, to suspend or terminate this promotion.
8. Any and all disputes relating to this promotion or any gift shall be subject to the internal laws of the Commonwealth of Massachusetts and the exclusive jurisdiction and venue shall be in the state or federal courts located Boston, Massachusetts.
9. Potential recipients of the Apple^® Store gift card, iPod Touch^® or iPad^™ will be required to sign an affidavit of eligibility, publicity and release of liability within 10 days of Brightcove’s selection of potential recipients in order to receive the gift.
10. Potential recipients of the Apple^® Store gift card, iPod Touch^® or iPad^™ will be determined on or around December 6, 2010. Potential recipients of the Apple^® Store gift card, iPod Touch^® or iPad^™ will be required to sign an affidavit of eligibility, publicity and release of liability within 10 days of Brightcove’s selection of potential recipients in order to receive the gift. In the event that Brightcove does not receive the affidavit of eligibility, publicity and release of liability within the 10 days, an alternate recipient who otherwise meets the eligibility requirements set out in these promotional rules may be chosen.
